Please read these terms and conditions carefully before using our site. By using our site, or any part of it, you agree that you have read these terms and conditions and agree to be bound by them.

Customer registration

You must register in order to be able to place an order on this website. Information supplied is understood to be complete and correct at time of registration.

You must safeguard your user name and your password.

You authorize us to assume that any person using this site with your username and password is either you or authorized by you.

You must inform us without delay of any changes in the information you provided us with, during your registration.

We have the absolute discretion to refuse or terminate the registration of any potential or existing customer.

Order

We will not sell or deliver alcohol to anyone who is, or appears to be, under the age of 18. By placing an order you confirm that you are at least 18 years old and we reserve the right not to deliver if we are unsure of this.

We cannot guarantee availability of all products. In the event that a product is unavailable when you place your order, we shall contact you to arrange replacement, or another acceptable arrangement for the completion of your order.

We reserve the right not to accept any order.

Prices are subject to change without prior notice and all orders are subject to our acceptance at our sole discretion and subject to stock availability.

The placing of an order anywhere on our website does not constitute a contract, which is made only when we accept your order and process payment.

Minimum order value for free delivery in Hong Kong is HK$2,000. A delivery fee of HK$250 will be charged on your invoice for orders below the minimum order value.

For Macau, the delivery and custom fee to be charged on your invoice is:

• HK$800 for orders below HK$4,000

• HK$400 for orders between HK$4,001 and HK$7999, and

• Waived for orders equal to or above HK$8,000.

Delivery

In Hong Kong, delivery is available only on HK island, Kowloon and New Territories (excluding Ma Wan). We do not deliver to any Outlying Island (e.g. Lantau, Lamma, Peng Chau, Cheung Chau…) or any areas where trucks are prohibited from entering or a special permit is required. We do not deliver to hotels’ guest rooms. Delivery service is not available if there is no legitimate unloading area within 50 meters of the of the delivery address. It is the user’s responsibility to inform us of any change of delivery address.

Delivery service is available when normal lift access is secured.

Delivery days are Monday to Friday (excluding public holidays), and delivery time is between 10 am and 6 pm.

Our office working hours are Monday to Friday from 9 am to 6 pm (excluding public holidays).

Please place your order on or before 2 pm (Monday to Friday) to receive our quotation on the same working day. If the order is placed after 2 pm (Monday to Friday) or on Saturday, Sunday or public holiday, then we will email you our quotation on the next working day.

Please confirm our quotation by email and make your payment in full within 48 hrs of receiving our quotation. If we do not receive your confirmation within 5 days, you shall be deemed to have cancelled your order.

Delivery shall be arranged on the next delivery day after we have received your payment in full.

Exceptionally, we can arrange some deliveries on Saturdays. Please contact us if you need your order to be delivered on a Saturday, so we can discuss such arrangements.

Delivery is not possible on Sundays and public holidays.

We will only attempt to deliver the product once, after which the products will be returned to our warehouse. We reserve the right to pass on the cost of redelivery in this event.

Prices & Vintages

Promotional offers and prices are as stated, with no further discounts available. All products are listed in HK dollars.

Although we endeavour to ensure that all pricing information on this website is accurate, occasionally an error may occur and goods may be miss-priced. If we discover a pricing error we will, at our discretion, either:

• contact you and ask you whether you wish to cancel your order or continue with the order at the correct price; or

• notify you that we have cancelled your order.

We will not be obliged to supply goods at the incorrect price.

We reserve the right to adjust prices, offers, goods and specifications of goods at our discretion at any time before (but not after) we accept your order. Where an end date is specified on any offer on the website, it is intended as a guide only. We reserve the right to change prices at any time.

In case the vintage you require is out of stock, we shall inform you when we receive your order and wait for your confirmation before proceeding with your order.

Returns, breakages and defective wines

All orders are carefully checked before delivery to ensure the quality of goods. Nevertheless, should you find that a bottle of wine is defective, such as its taste or breakage, please notify us by email within 24 hours with the following information: Wine code, Vintage, description of the defect and a picture if helpful (for example breakage). We will then take into account your comments to decide whether to replace or refund that bottle, in which case the faulty bottle shall be returned to us.

We reserve the right to refuse returns if in our reasonable opinion, we do not consider the item to be faulty.

Title of Goods

The goods shall remain our property until fully paid. We have the right to claim back any unpaid goods. All risks in the products shall pass to the Customer upon delivery.

Documents

For each order, you shall receive first a quotation for confirmation and payment, and then an invoice (by email) and a delivery note upon delivery.

Payment Terms

Payment shall be made in Hong Kong Dollars, either by bank transfer (you will find our bank details on the quotation) or by cheque made in favour of “Burgundy Wine Company” and mailed to our office (address available on the quotation).

Post-dated cheques are not acceptable.

Force Majeure

We shall not be liable for any delay or failure in our performance caused by or resulting from acts of God, fire, flood, accident, riot, war, government intervention, embargoes, strikes, labour difficulties, equipment failure, or any other causes beyond our control.

In case of Typhoon signal 8 or black rain warning, delivery will be suspended.

These terms and conditions are governed by the laws of Hong Kong Special Administrative Region. Both the User and Burgundy Wine Company agree to submit to the jurisdiction of the Hong Kong court.
